When a person is arrested and charged with a crime, the constitution grants people reasonable access to bail. In some cases people can afford to pay their own bail, but the majority of the time this is not the case. When a person does not have the ability to post their own bail they can enter a contract with a bail bondsman. The bondsman will cover the person’s bail amount, and in return the person must pay the bondsman a percentage of the bail amount. The severity of the charge will determine the bail amount, and the fee owed to the bail bondsman is typically 10% of the bail. The contract requires the accused person to show up to their first court date, otherwise the bondsman is forced to forfeit the bail they paid. If the accused person “skips” bail, the bondsman is then permitted to use enforcement agents to track down and force the person to appear in court.
